LegalBench: A Collaboratively Built Benchmark for Measuring Legal Reasoning in Large Language ModelsNeel Guha, Julian Nyarko, Daniel E. Ho et al.
The advent of large language models (LLMs) and their adoption by the legal community has given rise to the question: what types of legal reasoning can LLMs perform? To enable greater study of this question, we present LegalBench: a collaboratively constructed legal reasoning benchmark consisting of 162 tasks covering six different types of legal reasoning. LegalBench was built through an interdisciplinary process, in which we collected tasks designed and hand-crafted by legal professionals. Because these subject matter experts took a leading role in construction, tasks either measure legal reasoning capabilities that are practically useful, or measure reasoning skills that lawyers find interesting. To enable cross-disciplinary conversations about LLMs in the law, we additionally show how popular legal frameworks for describing legal reasoning -- which distinguish between its many forms -- correspond to LegalBench tasks, thus giving lawyers and LLM developers a common vocabulary. This paper describes LegalBench, presents an empirical evaluation of 20 open-source and commercial LLMs, and illustrates the types of research explorations LegalBench enables.

The 2025 AI Agent Index: Documenting Technical and Safety Features of Deployed Agentic AI SystemsLeon Staufer, Kevin Feng, Kevin Wei et al. · cambridge
Agentic AI systems are increasingly capable of performing professional and personal tasks with limited human involvement. However, tracking these developments is difficult because the AI agent ecosystem is complex, rapidly evolving, and inconsistently documented, posing obstacles to both researchers and policymakers. To address these challenges, this paper presents the 2025 AI Agent Index. The Index documents information regarding the origins, design, capabilities, ecosystem, and safety features of 30 state-of-the-art AI agents based on publicly available information and email correspondence with developers. In addition to documenting information about individual agents, the Index illuminates broader trends in the development of agents, their capabilities, and the level of transparency of developers. Notably, we find different transparency levels among agent developers and observe that most developers share little information about safety, evaluations, and societal impacts. Frontier AI Regulation: Managing Emerging Risks to Public SafetyMarkus Anderljung, Joslyn Barnhart, Anton Korinek et al.
Advanced AI models hold the promise of tremendous benefits for humanity, but society needs to proactively manage the accompanying risks. In this paper, we focus on what we term "frontier AI" models: highly capable foundation models that could possess dangerous capabilities sufficient to pose severe risks to public safety. Frontier AI models pose a distinct regulatory challenge: dangerous capabilities can arise unexpectedly; it is difficult to robustly prevent a deployed model from being misused; and, it is difficult to stop a model's capabilities from proliferating broadly. To address these challenges, at least three building blocks for the regulation of frontier models are needed: (1) standard-setting processes to identify appropriate requirements for frontier AI developers, (2) registration and reporting requirements to provide regulators with visibility into frontier AI development processes, and (3) mechanisms to ensure compliance with safety standards for the development and deployment of frontier AI models. Industry self-regulation is an important first step. However, wider societal discussions and government intervention will be needed to create standards and to ensure compliance with them. We consider several options to this end, including granting enforcement powers to supervisory authorities and licensure regimes for frontier AI models. Finally, we propose an initial set of safety standards. These include conducting pre-deployment risk assessments; external scrutiny of model behavior; using risk assessments to inform deployment decisions; and monitoring and responding to new information about model capabilities and uses post-deployment. We hope this discussion contributes to the broader conversation on how to balance public safety risks and innovation benefits from advances at the frontier of AI development.

Legal Alignment for Safe and Ethical AINoam Kolt, Nicholas Caputo, Jack Boeglin et al.
Alignment of artificial intelligence (AI) encompasses the normative problem of specifying how AI systems should act and the technical problem of ensuring AI systems comply with those specifications. To date, AI alignment has generally overlooked an important source of knowledge and practice for grappling with these problems: law. In this paper, we survey the emerging field of legal alignment that aims to fill this gap and systematize research that studies how legal rules, principles, and methods can be leveraged to address problems of alignment and inform the design of AI systems that operate safely and ethically. Our survey provides a taxonomy of the three core research pathways of legal alignment and explores how each can be operationalized in practice: (1) designing AI systems to comply with the content of legal rules developed through legitimate institutions and processes, (2) adapting methods from legal interpretation to guide how AI systems reason and make decisions, and (3) harnessing legal concepts as a structural blueprint for confronting challenges of reliability, trust, and cooperation in AI systems. These research pathways present new conceptual, empirical, and institutional questions, which include examining the specific set of laws that particular AI systems should follow, creating evaluations to assess their legal compliance in real-world settings, and developing governance frameworks to support the implementation of legal alignment in practice. Tackling these questions requires expertise across law, computer science, and other disciplines, offering these communities the opportunity to collaborate in designing AI for the better.

Superintelligence and LawNoam Kolt
The prospect of artificial superintelligence -- AI agents that can generally outperform humans in cognitive tasks and economically valuable activities -- will transform the legal order as we know it. Operating autonomously or under only limited human oversight, AI agents will assume a growing range of roles in the legal system. First, in making consequential decisions and taking real-world actions, AI agents will become de facto subjects of law. Second, to cooperate and compete with other actors (human or non-human), AI agents will harness conventional legal instruments and institutions such as contracts and courts, becoming consumers of law. Third, to the extent AI agents perform the functions of writing, interpreting, and administering law, they will become producers and enforcers of law. These developments, whenever they ultimately occur, will call into question fundamental assumptions in legal theory and doctrine, especially to the extent they ground the legitimacy of legal institutions in their human origins. Attempts to align AI agents with extant human law will also face new challenges as AI agents will not only be a primary target of law, but a core user of law and contributor to law. To contend with the advent of superintelligence, lawmakers -- new and old -- will need to be clear-eyed, recognizing both the opportunity to shape legal institutions as society braces for superintelligence and the reality that, in the longer run, this may be a joint human-AI endeavor.

AI agents -- systems that can independently take actions to pursue complex goals with only limited human oversight -- have entered the mainstream. These systems are now being widely used to produce software, conduct business activities, and automate everyday personal tasks. While AI agents implicate many areas of law, ranging from agency law and contracts to tort liability and labor law, they present particularly pressing questions for the most globally consequential AI regulation: the European Union's AI Act. Promulgated prior to the development and widespread use of AI agents, the EU AI Act faces significant obstacles in confronting the governance challenges arising from this transformative technology, such as performance failures in autonomous task execution, the risk of misuse of agents by malicious actors, and unequal access to the economic opportunities afforded by AI agents. We systematically analyze the EU AI Act's response to these challenges, focusing on both the substantive provisions of the regulation and, crucially, the institutional frameworks that aim to support its implementation. Our analysis of the Act's allocation of monitoring and enforcement responsibilities, reliance on industry self-regulation, and level of government resourcing illustrates how a regulatory framework designed for conventional AI systems can be ill-suited to AI agents. Taken together, our findings suggest that policymakers in the EU and beyond will need to change course, and soon, if they are to effectively govern the next generation of AI technology.

Benchmarks are important tools for tracking the rapid advancements in large language model (LLM) capabilities. However, benchmarks are not keeping pace in difficulty: LLMs now achieve over 90\% accuracy on popular benchmarks like MMLU, limiting informed measurement of state-of-the-art LLM capabilities. In response, we introduce Humanity's Last Exam (HLE), a multi-modal benchmark at the frontier of human knowledge, designed to be the final closed-ended academic benchmark of its kind with broad subject coverage. HLE consists of 2,500 questions across dozens of subjects, including mathematics, humanities, and the natural sciences. HLE is developed globally by subject-matter experts and consists of multiple-choice and short-answer questions suitable for automated grading. Each question has a known solution that is unambiguous and easily verifiable, but cannot be quickly answered via internet retrieval. State-of-the-art LLMs demonstrate low accuracy and calibration on HLE, highlighting a significant gap between current LLM capabilities and the expert human frontier on closed-ended academic questions. Increased delegation of commercial, scientific, governmental, and personal activities to AI agents -- systems capable of pursuing complex goals with limited supervision -- may exacerbate existing societal risks and introduce new risks. Understanding and mitigating these risks involves critically evaluating existing governance structures, revising and adapting these structures where needed, and ensuring accountability of key stakeholders. Information about where, why, how, and by whom certain AI agents are used, which we refer to as visibility, is critical to these objectives. In this paper, we assess three categories of measures to increase visibility into AI agents: agent identifiers, real-time monitoring, and activity logging. For each, we outline potential implementations that vary in intrusiveness and informativeness. We analyze how the measures apply across a spectrum of centralized through decentralized deployment contexts, accounting for various actors in the supply chain including hardware and software service providers. Finally, we discuss the implications of our measures for privacy and concentration of power. Further work into understanding the measures and mitigating their negative impacts can help to build a foundation for the governance of AI agents.

Mitigating the risks from frontier AI systems requires up-to-date and reliable information about those systems. Organizations that develop and deploy frontier systems have significant access to such information. By reporting safety-critical information to actors in government, industry, and civil society, these organizations could improve visibility into new and emerging risks posed by frontier systems. Equipped with this information, developers could make better informed decisions on risk management, while policymakers could design more targeted and robust regulatory infrastructure. We outline the key features of responsible reporting and propose mechanisms for implementing them in practice.

Leading AI developers and startups are increasingly deploying agentic AI systems that can plan and execute complex tasks with limited human involvement. However, there is currently no structured framework for documenting the technical components, intended uses, and safety features of agentic systems. To fill this gap, we introduce the AI Agent Index, the first public database to document information about currently deployed agentic AI systems. For each system that meets the criteria for inclusion in the index, we document the system's components (e.g., base model, reasoning implementation, tool use), application domains (e.g., computer use, software engineering), and risk management practices (e.g., evaluation results, guardrails), based on publicly available information and correspondence with developers. We find that while developers generally provide ample information regarding the capabilities and applications of agentic systems, they currently provide limited information regarding safety and risk management practices. Governing AI AgentsNoam Kolt
The field of AI is undergoing a fundamental transition from generative models that can produce synthetic content to artificial agents that can plan and execute complex tasks with only limited human involvement. Companies that pioneered the development of language models have now built AI agents that can independently navigate the internet, perform a wide range of online tasks, and increasingly serve as AI personal assistants and virtual coworkers. The opportunities presented by this new technology are tremendous, as are the associated risks. Fortunately, there exist robust analytic frameworks for confronting many of these challenges, namely, the economic theory of principal-agent problems and the common law doctrine of agency relationships. Drawing on these frameworks, this Article makes three contributions. First, it uses agency law and theory to identify and characterize problems arising from AI agents, including issues of information asymmetry, discretionary authority, and loyalty. Second, it illustrates the limitations of conventional solutions to agency problems: incentive design, monitoring, and enforcement might not be effective for governing AI agents that make uninterpretable decisions and operate at unprecedented speed and scale. Third, the Article explores the implications of agency law and theory for designing and regulating AI agents, arguing that new technical and legal infrastructure is needed to support governance principles of inclusivity, visibility, and liability.

AI systems are increasingly pervasive, yet information needed to decide whether and how to engage with them may not exist or be accessible. A user may not be able to verify whether a system has certain safety certifications. An investigator may not know whom to investigate when a system causes an incident. It may not be clear whom to contact to shut down a malfunctioning system. Across a number of domains, IDs address analogous problems by identifying particular entities (e.g., a particular Boeing 747) and providing information about other entities of the same class (e.g., some or all Boeing 747s). We propose a framework in which IDs are ascribed to instances of AI systems (e.g., a particular chat session with Claude 3), and associated information is accessible to parties seeking to interact with that system. We characterize IDs for AI systems, provide concrete examples where IDs could be useful, argue that there could be significant demand for IDs from key actors, analyze how those actors could incentivize ID adoption, explore a potential implementation of our framework for deployers of AI systems, and highlight limitations and risks. IDs seem most warranted in settings where AI systems could have a large impact upon the world, such as in making financial transactions or contacting real humans. With further study, IDs could help to manage a world where AI systems pervade society.

Black-Box Access is Insufficient for Rigorous AI AuditsStephen Casper, Carson Ezell, Charlotte Siegmann et al.
External audits of AI systems are increasingly recognized as a key mechanism for AI governance. The effectiveness of an audit, however, depends on the degree of access granted to auditors. Recent audits of state-of-the-art AI systems have primarily relied on black-box access, in which auditors can only query the system and observe its outputs. However, white-box access to the system's inner workings (e.g., weights, activations, gradients) allows an auditor to perform stronger attacks, more thoroughly interpret models, and conduct fine-tuning. Meanwhile, outside-the-box access to training and deployment information (e.g., methodology, code, documentation, data, deployment details, findings from internal evaluations) allows auditors to scrutinize the development process and design more targeted evaluations. In this paper, we examine the limitations of black-box audits and the advantages of white- and outside-the-box audits. We also discuss technical, physical, and legal safeguards for performing these audits with minimal security risks. Given that different forms of access can lead to very different levels of evaluation, we conclude that (1) transparency regarding the access and methods used by auditors is necessary to properly interpret audit results, and (2) white- and outside-the-box access allow for substantially more scrutiny than black-box access alone.

Current approaches to building general-purpose AI systems tend to produce systems with both beneficial and harmful capabilities. Further progress in AI development could lead to capabilities that pose extreme risks, such as offensive cyber capabilities or strong manipulation skills. We explain why model evaluation is critical for addressing extreme risks. Developers must be able to identify dangerous capabilities (through "dangerous capability evaluations") and the propensity of models to apply their capabilities for harm (through "alignment evaluations"). These evaluations will become critical for keeping policymakers and other stakeholders informed, and for making responsible decisions about model training, deployment, and security.
